JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2019 The petitioners apprehend their arrest in connection with Pandaul P.S.Case No. 187 of 2018 registered under Sections 272, 273, 406 and 420/34 of the Indian penal Code and Sections 30(a), 26, 38(1) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioners is of recovery of huge quantity of liquor from two co-accused persons and petitioners were succeeded in fleeing away. Further, it appears that petitioners are accused in two other cases.

Submission of learned counsel for the petitioners is that nothing has been recovered from their possession and they have been made accused on the basis of disclosure of their names by co-accused persons and other cases were relating to drinking of liquor but they are on bail in those cases.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to them rather they should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered on its own merit without being prejudiced by this order.
