The petitioner is accused in connection with Laxmipur P.S. Case No. 202 of 2015, registered under Section 399, 402, 120(B)/34 of the Indian Penal Code and Section 25 (1B)A, 26 of the Arms Act. The accusation is that the in course of evening duty, Police received information about gathering of four accused, including petitioner, near Dharwa forest in a tempo for making the plan to commit dacoity. When Police personnel reached there, then all persons succeeded to flee away taking the advantage of darkness. On search of tempo, a country made rifle, a sword and bhujali recovered from the said tempo. Learned counsel for the petitioner submits that it

Patna High Court Cr.Misc. No.19790 of 2016 (2) dt.12-05-2016 2/2 would appear from the F.I.R. that the petitioner was not apprehended on the spot rather he has been implicated in this case mere on suspicion. The petitioner having no criminal antecedent is in custody since 30.12.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Amrendra Kumar, J.M. 1st Class, Jamui in connection with Laxmipur P.S.
