2. The petitioners apprehend their arrest in connection with Muffasil P.S. Case No. 345 of 2024, registered for the offence punishable under Sections 341, 323, 307, 447, 385, 504, 506/34 of I.P.C. and Section 27 of Arms Act.

3. The case of the prosecution, in short, is that the informant alleged that while he was constructing a boundary wall on his paternal land in Mauza-Salempur, in the meantime, all the FIR named accused along with some unknown persons

Patna High Court CR. MISC. No.6281 of 2025(3) dt.09-05-2025 2/3 arrived armed with weapons, abused him and demanded Rs. 10 lakhs as extortion and objected to the boundary work. Petitioner no. 1 fired at the informant but missed.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. They have falsely been implicated in the present case due to land dispute. The petitioner nos. 1, 2 and 3 are own cousin brother of the informant and petitioner no. 4 is the cousin nephew of the informant. The petitioners have clean antecedent

5. Learned A.P.P. for the State opposes the prayer of anticipatory bail.

6. From the allegations levelled in the FIR, prima facie, it appears to be a dispute between the family members with regard to construction of a boundary wall in MauzaSalempur. There is no specific allegation against any of the petitioners. There is general and omnibus allegation that all the petitioners of assaulting the informant with fist and slaps. Under these circumstances, this Court is inclined to grant privilege of anticipatory bail to the petitioners.

7. Let the petitioners, named above, in the event of their arrest or surrender before the Court below within four weeks from today, be released on bail on furnishing bail bond of

No.6281 of 2025(3) dt.09-05-2025 3/3 Rs.25,000/- (Twenty Five thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 345 of 2024, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
