JUSTICE SUDHIR SINGH ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 20, 22, 23, 27A and 29 of the N.D.P.S. Act. Allegation is that nine persons were carrying a bag containing ganja. On chase, they fled away throwing the bag and petitioner was apprehended.
Bail application of petitioner was earlier rejected vide Annexure-1 to the present application. This is the second attempt for bail on behalf of petitioner. A report was called for from the trial court. It has been reported that evidence has already been closed and the case has been fixed for argument and it is expected that within a period of one month the trial is going to be concluded.
Patna High Court Cr.Misc. No.28576 of 2015 (4) dt.14-12-2016 2/2 Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage, same is rejected.
