The petitioner seeks bail in a case instituted for the offences under Sections 395 and 412 of the Indian Penal Code.. The prosecution case in short is that while the informant along with one person was returning, the accused persons snatched cash amount and some documents from his pocket.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.8.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The name of the petitioner has transpired in the present case as

Except for this, there is no substantive evidence to suggest his implication in the present case. There is no recovery of any incriminating articles from the petitioner. The petitioner has not been put on T.I.P.. Other co-accused has been granted bail vide order dated 11.1.2019 passed in Cr. Misc. No. 73743 of 2018. On behalf of the State, it is submitted that the petitioner is named in the F.I.R..

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional District & Sessions Judge, Bhagalpur in connection with S.T. Case No. 796/18 arising out of Mojahidpur (Babarganj) P.S. Case No. 117/18.
