JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioneris in jail custody since 01.09.2018 in connection with Jagdishpur P.S.Case No. 311 of 2018 registered for the offences punishable under Sections 396 of the Indian Penal Code and 27 of the Arms Act.

Petitioner is not named in the first information report and Para-59 of the case diary goes to show that for the first time name of this petitioner came in this case when co-accused Ajay Kumar @ Raja was arrested in this case and made his confessional statement disclosing his involvement in the present case. The aforesaid Ajay Kumar@ Raja also disclosed that he along with three others committed dacoity and so far as petitioner is concerned, he had played the role of liner in the

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the investigation against this petitioner has already been completed, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XI, Bhojpur in connection with Jagdishpur P.S.Case No. 311 of 2018.
