Patna High Court CWJC No.5015 of 2021(6) dt.23-03-2022 2/2 retiral dues including pension of her husband who retired as Chaukidar after serving 32 years in the department in light of the direction issued by the Division Bench of this Court passed in LPA No. 969/2015 and its analogous cases in which husband of the petitioner was one of the appellants in LPA No. 177/2017. Permission is granted.

The present writ application is disposed of as withdrawn with the aforesaid liberty.

It is made clear that if the representation, in light of aforesaid LPA and in light of Full Bench decision rendered in the case of Mobina Khatoon v. The State of Bihar & Ors as reported in 2019 (1) PLJR 1015, is filed by the petitioner within a period of four weeks from today, the same shall be disposed by the Principal Secretary, Department of Water Resources, Government of Bihar, Sinchai Bhawan, Patna by a reasoned order in accordance with law within a further period of two months from the date of filing of representation after giving opportunity of hearing to the petitioner or her representative.
