JUSTICE AMARESH KUMAR LAL ORAL ORDER 13-08-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 269, 270, 418, 420, 120B of the Indian Penal Code, Section 5 of Medical Termination of Pregnancy Act, 1971 and Sections 15 (2) (D) of All India Medical Council Act, 1956.

The petitioner is the proprietor of M/S Raj Laxmi Nursing Home, Purani Jail Road, Nawada in which a patient was found admitted and the doctor was also found working. It is submitted that there is no allegation against the petitioner. No complain has been made regarding the management and functioning of the nursing home. In similar facts and circumstances, the co-accused Ajay Kumar Lal, proprietor of M/S/ Maa Gulabiya Nursing Home, Nawada, has been granted

Patna High Court Cr.Misc. No.29772 of 2015 (2) dt.13-08-2015 2/2 anticipatory bail vide Cr. Misc. No.29006 of 2015. The petitioner has been in custody since 25.05.2015 having no criminal antecedent.

Considering the facts and circumstances of the case, let the above-named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in Nawada Town P.S. Case No.343 of 2015 with the following conditions :

1.

One of the bailors will be the close relative of the petitioner.

2.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
