JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-04-2023 The present writ petition has been filed seeking the following relief:- "That by way of this writ application, the petitioner craves indulgence of this Hon'ble Court for an order/direction to the respondents for immediate removal of encroachment from the gair Majrua Aam land of the Road bearing Khata No.- 176, Khesra NO.-414, Thana no.-18, MaujaJakarpura, Anchal- Suryagarha in the DistrictLakhisarai. Which is at present bern illegally encroached by some persons but the Circle officer, Suryagarha in collusion with them has not taken any steps for the removal of encroachment from the said public land, even after the direction of the S.D.M, Suryagarha."

Patna High Court CWJC No.11276 of 2017(2) dt.18-04-2023 2/2 At the outset, learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Suryagarha, District-Lakhisarai for redressal of his aforesaid grievances. Liberty so sought is granted.

It is needless to state that in case, the petitioner approaches the Circle Officer, Suryagarha, District-Lakhisarai by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The present writ petition stands disposed off on the aforesaid terms.
