JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner seeks bail in connection with Runnisaidpur P. S. Case No. 411 of 2014 registered under Sections 302 and 201/34 of the Indian Penal Code. It is contended that entire case is based on mere suspicion and similarly circumstanced other two co-accused, namely, Dr. Tuntun Rai, Nathuni Sah and Munni Devi have already been granted bail under Section 438 of the Code of Criminal Procedure by different orders passed by different Benches of this Court. The order passed in the case of Dr. Tuntun Rai has been brought on record vide Annexure-2 to the

Patna High Court Cr.Misc. No.21534 of 2016 (2) dt.19-05-2016 2/2 present application.

Regard being had to the nature of allegation made in the FIR, submissions made by the parties before the court below and the reasons assigned in the order dated 21.07.2015 passed in Cr. Misc. No. 27429 of 2015 (Annexure-2), the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in Runnisaidpur P. S. Case No. 411 of 2014.
