The petitioner seeks regular bail in connection with Special case no. 04 of 2013 registered for the offence punishable under Sections 420, 477A and other sections of Indian Penal Code and 13(2) r/w 13(1)(d) of Prevention of Corruption Act.
The allegation as per the prosecution is that the accused persons including the petitioner herein had obtained job with the postal department on the basis of fake certificates. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, he is having a clean antecedent and is languishing
Patna High Court Cr.Misc. No.6204 of 2019(2) dt.04-02-2019 2/2 in custody since 07.01.2019. It is further submitted that the petitioner has already been terminated from service, hence he has been suitably punished. Lastly, it is submitted that similarly situated co-accused persons have already been granted bail, one of such order being dated 20.12.2018 passed in Cr. Misc. no. 77010 of 2018. The petitioner is stated to be having clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge CBI-II, Patna in connection with Special case no. 04 of 2013.
