JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 349 of the Indian Penal Code and Section 27 of the Arms Act.

Taking into note of the fact that the petitioner is the main assailant, I am not inclined to release him on bail. Hence, his prayer for bail in connection with Ratanpura P.S. Case No. 51 of 2014, pending in the Court of Chief Judicial Magistrate, Supaul stands rejected.

However, the concerned trial court is directed to expedite the trial of the petitioner and conclude the same as early as possible.
