JUSTICE AMARESH KUMAR LAL ORAL ORDER 10-08-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offence punishable under Section 302 IPC.
Allegation against the petitioner is to have took out a pistol from his waist and shot Kanti Devi (deceased) dead. When the persons from the vicinity arrived, the petitioner fled away. It is submitted that no blood was found on the place of occurrence. There is no sign of firing. The petitioner has no criminal antecedent.
It appears that the petitioner is the main assailant and it appears from the order dated 6.6.2015 passed by the learned Ad hoc Sessions Judge II, Aurangabad that the trial is going on and six witnesses including the informant have already been examined.
Patna High Court Cr.Misc. No.28507 of 2015 (2) dt.10-08-2015 2/2 Considering the facts and circumstances, in my opinion, the petitioner does not deserve bail at this stage. His prayer for bail is rejected.
