JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 147, 149, 328, 302 of the Indian Penal Code.

Petitioners are in-laws of the deceased and informant is mother of the deceased. The informant claims that the deceased was poisoned to death by petitioners and others after assaulting her. The postmortem report of the deceased reveals that no external injury was found on her person and the Viscera was sent to Forensic Science Laboratory, Patna for chemical

Submission of behalf of the petitioners is that the deceased was taken to hospital by petitioners and others and the aforesaid fact goes to show that the deceased was never poisoned by the petitioners.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner no. 1 and 2 are women whereas petitioner no. 3 is an old person, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st, Banka in connection with Suiya P. S. Case No. 36 of 2018.
