Petitioner seeks bail in a case registered under section 302/34 of the Indian Penal Code.
According to the first information report husband of the informant was killed by the miscreants, who were seen fleeing away by the brother of the informant. On behalf of the petitioner it is submitted that the petitioner is in custody since 29.05.2015. It is submitted that the petitioner has been implicated in this case due to village politics. There is no direct evidence against the petitioner. On behalf of the State and the informant it is submitted that petitioner is one of the assailant. It is submitted that
Patna High Court Cr.Misc. No.29418 of 2015 (2) dt.05-08-2015 2/2 the deceased has made statement to his wife that the petitioner has assaulted him.
Considering the aforesaid fact, I am not inclined to grant bail to the petitioner. The same is rejected. However, the trial court is directed to take all necessary steps to conclude the trial preferably within a period of nine months from the date of receipt/production of a copy of this order.
