JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 376 D of the Indian Penal Code and Sections 6, 8 of POCSO Act.

Petitioner and two others are named in the first information report with accusation that they committed gang rape on informant but in course of trial, the informant was examined as prosecution witness no. 1 and she stated that co-accused, Dilip Yadav had committed rape on her as a result whereof, she became pregnant and after six months of her pregnancy the aforesaid fact came to the notice of her parents and then she lodged the present case. Moreover, co-accused, Ravi Kant Yadav and Dilip Kumar

Patna High Court Cr.Misc. No.20536 of 2016 (2) dt.19-05-2016 2/2 Yadav have already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge, Siwan in connection with Mahila P.S.
