The petitioner is languishing in custody since 31.12.2015 in connection with Amas P.S. Case No. 210 of 2015 for the offences instituted under Section 392 of the IPC. The prosecution story, in brief, is that the truck of the informant was stolen away by the accused persons. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 31.12.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering with the evidence against the petitioner. He is not named in the F.I.R. He has not been put on T.I.P. to ascertain the involvement of the

As per the confession, the petitioner wanted to purchase a truck from one Bharat and for the said reason the truck was parked by the side of the house. There is no material to suggest that the petitioner committed an offence under Section 392 of the IPC.

On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.Ist Class, Sherghati, Gaya, in connection with Amas P.S. Case No. 210/2015.
