JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2019 The petitioner apprehends his arrest in connection with Dalsingsarai P.S.Case No. 77 of 2017 registered under Sections 30(a)/38(i)(ii) of the Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is of recovery of 22 litres of liquor and it further appears that he is accused in two other cases one of them is of similar nature.
Submission of learned counsel for the petitioner is that nothing has been recovered from his possession rather from other co-accused person and in other cases also, nothing was recovered from the possession of the petitioner. Heard learned APP also.
Having heard both sides and in view of allegation as well as criminal antecedent, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this
