The petitioner seeks regular bail in Sahiyara P.S. Case No. 64/2011, registered for the offence punishable under Section 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that victim girl has given her statement under Section 164 Cr.P.C wherein she has not taken name of this petitioner. The victim girl in her statement has named Shobha Devi and Nilam Devi. In the written report, there is general and omnibus allegation against the petitioner. Shobha Devi and Nilam Devi have been granted bail by Coordinate Bench of this court. Petitioner is in custody since 12.09.2018 having clean antecedent. Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.4031 of 2019(2) dt.01-02-2019 2/2 prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned court of Fast Track Court II, Sitamarhi in connection with Sahiyara P.S. Case No. 64/2011, subject to the condition that both the bailors will be close relative of the petitioner.
