2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 30(a) and 41 of the Bihar Prohibition and Excise (Amendment) Act.

3. As per the prosecution case, total 259.17 litres of illicit English liquor has been recovered from two different vehicles.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is neither owner nor driver of any of the seized vehicles. Petitioner has got no concern with the alleged recovery.

5. Learned counsel for the State has opposed the

Patna High Court CR. MISC. No.4867 of 2025(2) dt.13-02-2025 2/2 prayer for bail of the petitioner and submits that petitioner has got three criminal antecedents of similar nature.

6. Considering the quantity of recovery and also criminal antecedents of similar nature, this pre-arrest bail petition is dismissed.
