JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 25-05-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month. Heard learned counsel for the petitioners as well as learned APP for the State.

In this case, the petitioners are seeking regular bail in connection with Buxar (Ind.) P.S. Case No. 222 of 2020, registered for the offences punishable under Sections 30(A) of Bihar Prohibition and Excise Act, 2018.

As per FIR, police got confidential information that coaccused Rajesh Chaudhary, Narsingh Ansari, Sanjay Chaudhary, Kishan Manjhi, Ghurav Manjhi, Umesh Yadav were carrying illicit liquor by boat owned by co-accused Akshay Lal. That boat was

Patna High Court CR. MISC. No.6214 of 2022(2) dt.25-05-2022 2/2 apprehended by the police. 7-8 miscreants became successful in fleeing away. Two of them were apprehended and they disclosed the name of the present petitioners. Cartons of English wine were recovered from that boat.

Learned counsel for the petitioners has submitted that the petitioners were not apprehended at the spot. Their names have figured in confessional statement of co-accused. Petitioner No. 1 is a person of clean antecedents whereas petitioner No. 2 is accused in one case. They are under custody since 29.11.2021. Considering the facts and circumstances as well as the period of custody, the petitioners above-named is directed to be released on bail after framing of charge on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Buxar in connection with Buxar (Ind.) P.S. Case No. 222 of 2020.

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
