The petitioner is aggrieved by the order of suspension. Learned counsel for the petitioner submits that the petitioner is under suspension for the last more than three years and even he has not been paid subsistence allowance. Learned counsel for the University submits that for the allegation of indiscipline, the petitioner has been put under suspension. He further submits that departmental proceeding would be completed within three months.
Considering the aforesaid, the writ application is disposed of with a direction to the respondent University to conclude the
Patna High Court CWJC No.921 of 2019(7) dt.13-04-2021 2/2 departmental proceeding positively within a period of three months, failing which not only the order of suspension, but the departmental proceeding shall also come to an end and the petitioner is entitled to reinstatement with full back wages. The University is obliged to pay the subsistence allowances, if not already paid, within a period of fifteen days from the date of receipt/production of a copy of this order.
