Petitioner is languishing in jail custody since 1505-2015 in a case registered under Section-376 of the Indian Penal Code.

According to the prosecution case itself, the petitioner is said to have committed rape on the informant in the year, 2008 but the present case was lodged in the year, 2014 i.e. after 6 years of the alleged occurrence. However, it has been alleged in the first information report that the petitioner used to establish physical relation with the

On the date of occurrence, the informant appears to be a major girl and therefore, considering the facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Samastipur Women/Mahila P.S.
