The petitioner is apprehending his arresting in connection with Kumarkhand P.S. Case No. 166 of 2022 for the offence under Section 366A of the I.P.C. and 8 of the POCSO Act lodged on 07.05.2022 by the informant Ramwati Devi. The prosecution story, in brief, is that the informant alleged that on 04.05.2022, the petitioner alongwith other coaccused persons kidnapped her minor daughter with intention to marriage and accordingly case has been filed. Learned counsel for the informant has taken this Court to the 164 Cr.P.C. statement of the victim girl to show that the petitioner was one of them who has taken the lady away. Considering the allegation that has come in the statement of the victim girl under Section 164 Cr.P.C., certainly,

Patna High Court CR. MISC. No.9019 of 2023(2) dt.22-05-2023 2/2 this cannot be a case for grant of anticipatory bail. Accordingly, the petition stands rejected.
