03-09-2020 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner seeks anticipatory bail in connection with Sasaram (Nagar) (T) P.S. Case No. 745 of 2019 registered for the offence under sections 302, 379, 34 of the Indian Penal Code and 27 of the Arms Act pending in the Court of C.J.M. Rohtas at Sasaram.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to previous enmity and oblique motive.

Patna High Court CR. MISC. No.4293 of 2020(2) dt.03-09-2020 -2- Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending that petitioner is named in the first information report. He has active participation in the alleged occurrence. Further he submits that petitioner has criminal antecedent. Hence, this is not a fit case for anticipatory bail. Having considered the facts and circumstances of the case and the submissions advanced on behalf of learned counsel for the State, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner for grant of anticipatory bail is rejected.
