Statement of victim has been recorded under section 164 of the Cr.P.C in which she stated that she had gone along with the petitioner on her own sweet will and, after that, she solemnized her marriage with the petitioner. The victim expressed her willingness to live with the petitioner.

No doubt, the victim disclosed her age as 17 years at the time of recording her statement under section 164 of the Cr.P.C and, similarly, the learned Judicial Magistrate also assessed her age as 17 years but taking into consideration the aforesaid facts and circumstances as well as submission of the parties, let the petitioner, above named, be released on bail on furnishing bail
