2. Petitioner seeks bail in a case registered for the offence punishable under Section 137(2) and 140 (3) of the B.N.S., 2023.

3. As per the prosecution case, on 14.10.2024, son of informant namely Ayush Kumar @ Kishan Kumar went to visit Durga temple at 5 PM, but did not return. Thereafter, informant and his relative started searching him but he was not found. F.I.R., has been lodged against unknown.

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has been falsely implicated in

He submits that instant case has been instituted against unknown and later, due to enmity, this petitioner has been made escape-goat in this case. Petitioner is in custody since 18.10.2024, having no criminal antecedent.

However, learned counsel for the informant vehemently opposes the prayer for bail and submits that it is a case of honour killing, in which, all the accused persons including this petitioner committed murder of son of informant on the suspicion that son of informant had love affair with one Amrita Kumari. During investigation, brother of Amrita Kumari confessed that he, alongwith petitioner and others killed the deceased. Post-mortem report reveals that multiple injuries were found on the body of deceased Ayush Kumar.

6. Considering the nature of accusation, material available on record and gravity of offence, the prayer for bail of the petitioner is rejected.
