JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Madanpur P.S. Case No. 133/2014 registered for the offences punishable under Sections 147, 148, 149, 341, 337, 353, 427, 504, 124(A) of the Indian Penal Code and 17 of C.L.A. Act. Petitioners are not named in the first information report and it appears from the impugned order that the name of petitioners came in course of investigation.

However, learned counsel appearing for petitioners pointed out that more or less similar allegation, some coaccused have already been granted privilege of anticipatory bail

Patna High Court CR. MISC. No.5057 of 2020(2) dt.03-03-2020 2/2 by co-ordinate Bench of this Court vide order dated 22.8.2019 passed in Cr. Misc. No. 35576/2019. He, further, submits that so far as the criminal antecedents of the petitioners are concerned, Madanpur P.S. Case No. 134/2014 and Madanpur P.S. Case No. 137/2014 have arisen out of the same occurrence. Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that above named petitioners, in the event of their arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad/concerned court in Madanpur P.S. Case No. 133/2014 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
