JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Initially, case was registered against unknown but in course of investigation, dead body of deceased was recovered and uncle of the deceased claimed that deceased was taken away from his house by the petitioner and one, Surti Lal Yadav and thereafter, dead body of the deceased was recovered. I find that some witnesses stated the above-said fact adding the name of some other persons and moreover, having more or less similar allegation, one co-accused namely, Suresh Yadav @ Chunilal Yadav has already been granted privilege of bail by a coordinate bench of this court vide order dated 06-012014 passed in Cr. Misc. No. 23911 of 2013.
Patna High Court Cr.Misc. No.34175 of 2015 (4) dt.03-11-2015 2/2 Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bithan Bazar P.S. Case No. 71 of 2012 to the satisfaction of Sri Mansoor Alam, learned Judicial Magistrate-Ist Class, Rosera, Samastipur.
