The petitioner seeks bail in a case registered under Sections 341, 432, 376, 506, 509, 34 of the Indian Penal Code. Allegation against the petitioner is that, the petitioner under allurement and enticement, took her to Delhi and established physical relationship with her.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 20-08-2018. Charge sheet has already been submitted. The victim is alleged to have travelled with the petitioner in train to Delhi. The victim, at no point of

Patna High Court CR. MISC. No.7389 of 2019(4) dt.25-04-2019 2/2 time, made any protest against the petitioner from Patna to Delhi or Delhi to Patna. The medical report of the doctor suggests that she is 18 years of age. No positive sign of commission of rape is said to have been found on the part of the victim.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned learned Additional Chief Judicial Magistrate-XIII, Bhagalpur in connection with Budhuchak P.S.
