The petitioner seeks bail in Biraul P.S. Case No.212 of 2019 registered for the offence punishable under Sections 376, 419, 420, 363/34 of the Indian Penal Code.

As per the F.I.R., the informant was married with one Dinesh Chaupal, who is a handicapped person and she blessed with one male child. It is alleged that the informant that on false promise of marriage, one Sonu Kumar developed sexual relationship with her. Thereafter, Sonu Kumar asked her to hand over her son to the petitioner and the victim handed over her son to the petitioner and thereafter the petitioner went away leaving the informant.

Submission of learned counsel for the petitioner is

Patna High Court CR. MISC. No.5847 of 2020(2) dt.03-02-2020 2/2 that the petitioner has been falsely implicated in this case having no criminal antecedent and he is in custody since 04.11.2019. It is submitted that the son of the informant has already been recovered. It is submitted that co-accused Sonu Kumar has already been granted bail by this Court vide order dated 18.01.2020 passed in Cr.Misc.No.3028 of 2020. Heard learned Addl. Public Prosecutor.

Considering facts and circumstances, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-(twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Biraul, District-Darbhanga in connection with Biraul P.S. Case No.212 of 2019.
