A truck parked near hotel Rimjhim, whereupon according to the prosecution party, they got confidential information to the effect that wine is being stealthily unloaded/ transported, raid was conducted followed with recovery in terms of the seizure list. It has also been disclosed as per the information given by the truck driver, that some cartons have been taken by Mohan Kumar, raid was also conducted at his place and during course thereof, the cartons full of wine bottles were seized along with other articles for which seizure list has been prepared.
It is further evident that during course of investigation police collected material to the effect that from the shop of the petitioner who is a wholesale dealer of wine at Haryana, wine
Patna High Court CR. MISC. No.7133 of 2020(4) dt.08-06-2020 2/2 was purchased, carried which was subject to recovery, more particularly from the inculpatory extra judicial confessional statement of Rabindra Kumar.
The petitioner is under custody since 20.12.2019 having clean antecedent as per para 3 of the petition. Consequent thereupon, petitioner Jaiveer Singh @ Jaibir Singh @ Jaiveer is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like mount each to the satisfaction of the learned 2nd Additional Sessions Judge cum Special Judge, Excise, Saran at Chapra in connection with Sonepur P.S. Case No.435 of 2016. However, it is made clear that the learned lower court will properly verify the authenticity, soundness of the bailors before issuance of release order in order to have the presence of the petitioner till the conclusion of the trial (Aditya Kumar Trivedi, J) skpathak/- U T
