JUSTICE SUDHIR SINGH) 25-02-2026 In the present writ petition, the petitioner has prayed for the following relief(s):- "(i) For quashing or directing the immediate revocation of the impugned blacklisting order bearing letter No. BMSIC/40030/494-2024/9691 dated 10.12.2025 issued by (BMSICL), Bihar Medical Services and Infrastructure Corporation Limited, with an order of blacklisting the petitioner for two years and
Patna High Court CWJC No.1532 of 2026(4) dt.25-02-2026 2/3 forfeiting the petitioner's security deposit. (ii) For directing the respondents to restore the eligibility of the petitioner M/s Athens Life Sciences to participate in all tenders, ongoing and future tenders and procurement process of BMSICL and Bihar State Health Department.
(iii) For direction upon the respondents to refund / release of any forfeited earnest money deposit (EMD)/Security Deposit / Performance guarantee if any along with statutory / admissible interest.
(iv) For a direction upon Respondent No.1 to dispose of pending representations dated 25.12.2025 and 08.01.2026 in accordance with law.
(v) For grant of interim stay of the operation of impugned order dated 10.12.2025.
(vi) For any other relief/s for which the petitioner may be found legally entitled in the facts and circumstances of the case."
2. Learned counsel for the petitioner seeks permission to withdraw the present writ application with liberty to avail the alternative remedy as available under the statute.
3. Considering the submission so made, the petitioner is granted liberty to approach the authority concerned by filing an appropriate representation, in accordance with law.
4. In the event such representation is filed, the authority concerned shall consider and dispose of the same by
Patna High Court CWJC No.1532 of 2026(4) dt.25-02-2026 3/3 passing a reasoned and speaking order, in accordance with law, affording due opportunity of hearing to all the concerned stakeholders.
5. Accordingly, with the aforesaid liberty, the present writ application stands disposed of as withdrawn.
