JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 This is an application for grant of anticipatory bail in connection with Nautan P.S. Case No. 357 of 2018, disclosing offences under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner, who is a lady, is of assault by a bamboo stick to the father of the informant, later on, he died.
Submission of learned counsel for the petitioner is that the deceased was aged about 95 years and he died due to fall on the ground as some witnesses have said in para nos.11 to 14 of the case diary and furthermore postmortem report does not show any external injury on the person of the deceased. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above
Patna High Court CR. MISC. No.5090 of 2019(3) dt.13-03-2019 2/2 named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, District- West Champaran, in connection with Nautan P.S. Case No. 357 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
