Petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code. Petitioner is said to have assaulted the deceased causing injury on his eye but submission on behalf of the petitioner is that no injury was found on the eye of the deceased and moreover, having more or less similar allegation co-accused Chhathu Rai and Tiwari Kumar have already been granted privilege of bail by a coordinate bench of this court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in Turkawaliya P.S.
