Learned counsel for the petitioner submits that the pay slip of the petitioner shows that the recommendation of first, second and third A.C.P./M.A.C.P. has been made, but that has not been translated in the reality and submits that concerned authority should take decision with regard to entitlement of petitioner for first, second and third A.C.P./M.A.C.P. In such view of the matter, let the petitioner file a detailed representation to the District Magistrate, Lakhisarai, attaching his pay slip. If such a representation is filed, the
Patna High Court CWJC No.505 of 2019(2) dt.22-05-2019 2/2 District Magistrate, Lakhisarai, shall decide the entitlement of the petitioner of all three A.C.Ps./ M.A.C.Ps. If the District Magistrate arrives to a finding that the petitioner is entitled to the benefit, in such circumstance, the benefit including enhancement in the pensionary benefit will be given to the petitioner without unnecessary delay. All the exercise should be completed by the District Magistrate, Lakhisarai, within a period of three months from the date of filing of representation by the petitioner.
With the aforesaid observations and directions, this writ petition is disposed of.
