=========================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 27-04-2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in Digha P.S. Case No. 57 of 2010 dated 08.03.2010 instituted under Sections 304B/34 of the Indian Penal Code.

This is the second attempt of the petitioner for bail as earlier such prayer was rejected by order dated 02.08.2014 in Cr. Misc. No. 31082 of 2014 arising out of same criminal case i.e., Digha P.S. Case No. 57 of 2010.

A co-accused namely Usha Devi had moved this Court, also for the second time in Cr. Misc. No. 11448 of 2015 in which pursuant to the report being called, the trial Court has found that the same is likely to be concluded within three months. Learned counsel for the petitioner submits that though a separate Sessions trial proceeding, arising out of the same P.S. case, is pending, but both the trials are being taken up

Patna High Court Cr.Misc. No.32500 of 2015 dt.27-04-2016 2/2 by the same Court and heard side by side.

In view of the aforesaid, this Court is not inclined to reconsider the earlier rejection with regard to granting bail to the petitioner. Accordingly, the application stands dismissed. However, since the trial Court itself has submitted a report stating that the trial is likely to be concluded within three months, the Court directs that the same be done positively latest by 31st July, 2016.
