Petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code. Informant claims himself to be eye witness of the alleged occurrence and states that five persons came at his house and one FIR named accused Baiju Mandal shot fire on the chest of the deceased and one FIR named accused Shankar Mandal assaulted the informant. In course of investigation, one co- accused was arrested and disclosed the name of Mahesh Rai stating his involvement in the present crime. After that Mahesh Rai, too, confessed his guilt disclosing the involvement of the petitioner in the present crime. It appears that except the aforesaid material as well as some criminal antecedent, there is nothing against the petitioner. Petitioner in jail custody since 2.2.2016 and investigation
Patna High Court Cr.Misc. No.19162 of 2016 (2) dt.05-05-2016 against him has already been completed.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Narpatganj P.S. Case no. 185/2014.
