The petitioner is languishing in custody since 14.12.2015 in connection with Chiksaura P.S. Case No.95 of 2015 for the offences instituted under Sections 413, 414 and 34 of the Indian Penal Code.
The prosecution case, in brief, is that the informant received a secret information that villagers, Budhu Yadav and his son Bipin Yadav along with his nephew have stolen some buffaloes and kept in their houses. It is alleged that after raid the police recovered the said buffaloes from their houses and the house of the petitioner.
It is submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.19142 of 2016 (3) dt.26-05-2016 petitioner has got no criminal antecedent. The petitioner is in custody since 14.12.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering with the evidence. The petitioner denies the seizure of buffalo from his possession. There is no compliance of Section 100 of the Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the first information report.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Chiksaura P.S. Case No.95 of 2015.
