.... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 26-05-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 395 and 397 of the Indian Penal Code. Prosecution case, in brief, is that while informant and his brother were going on a motorcycle, near the village Ghoghara Khandha, eight accused persons armed with Katta intercepted them, assaulted and snatched away Rs. 10,000/- from them. It has been submitted on behalf of the petitioner that he is in custody since 31. 3. 2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. He is not named in the F.I.R.
Petitioner's name has transpired on the basis of confessional statement of the coaccused. There is no recovery of any incriminating article from the possession of the petitioner. Petitioner has not been put on T.I.P. to ascertain his involvement in the present case. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond
Patna High Court Cr.Misc. No.19200 of 2016 (3) dt.26-05-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.D.J.IIIrd, Lakhisarai, in connection with Sessions Case no. 9 of 2016 arising out of Chanan P.S. Case no. 101 of 2014.
