The petitioner apprehends arrest in a case registered for offence punishable under sections 302/34 of the Indian Penal Code and under section 27 of the Arms Act.

Informant alleges that his brother was found lying dead on the road with his motorcycle and mobile phone. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of confessional statement of co-accused Manoj Chaubey. There is recovery of pistol and live and empty cartridges from the house of the petitioner.

In view of the nature of allegation, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its
