Patna High Court CR. MISC. No.4215 of 2022(2) dt.24-05-2022 2/3 as the learned Additional Public Prosecutor for the State. The petitioners are seeking regular bail in connection with Sheosagar P.S. Case No. 94 of 2021 registered for offence punishable under sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.
As per allegation, six named accused persons assaulted the father and brother of the informant. The informants' father was referred to the Sadar Hospital, Sasaram since his condition was serious.
The learned counsel for the petitioners has submitted that there is case and counter case. The petitioners' side has lodged case against the informant's side because they have molested the female family members of the petitioners. They have also submitted that although one of the injuries is fatal for life, but the petitioners are under custody for near about nine months. They are the persons of clean antecedents. Considering the clean antecedents as well as the period of their incarceration, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sheosagar P.S. Case No. 94 of 2021, subject
Patna High Court CR. MISC. No.4215 of 2022(2) dt.24-05-2022 3/3 to the following conditions:- (i) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
(ii) If the petitioners are found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioners and the learned court below will take decision in accordance with law.
Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
