The petitioners seek bail in a case registered for the offences punishable under sections 302,201 and other allied sections of the Indian Penal Code.

The petitioners are named in the F.I.R. but their names figured in the F.I.R. on mere suspicion that the petitioners had threatened to kill the son of the informant. The informant disclosed that his son Gopal went along with Santosh Mahton, Shambhu Sahni, Ram Krishna Kumar and Shaligram Paswan but his son did not return. During the course of investigation, Ashok Sahni, Wakil Sahni and Santosh Sahni confessed their guilt and on their disclosure, the dead body of the son of the informant was

Patna High Court Cr.Misc. No.29645 of 2015 (2) dt.10-08-2015 recovered. Motor Cycle Helmet and Samsung mobile having sim No. 35189806990 were recovered from the house of Ram Krishna Kumar. Except suspicion there is no tangible material collected against the petitioners.

Considering the facts aforesaid, let the petitioners above named be directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Rameshwar Mishra, Judicial Magistrate, 1st Class, Begusarai in connection with Birpur P.S.
