JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-467, 468, 399, 402, 471, 472, 420, 489(A),(B), (C) (E) of the Indian Penal Code and under Sections-25(i-B)A/26/35 of the Arms Act.

Although it is stated that petitioner was caught along with other accused while he as well as others were sitting in a room, from which, fake currency notes were recovered but admittedly, except mobile, nothing has been recovered from conscious possession of the petitioner and so far as recovery of fire-arm is concerned; the same has been recovered from conscious possession of other accused. Moreover, the petitioner

Patna High Court Cr.Misc. No.19186 of 2016 (2) dt.05-05-2016 2/2 does not have any criminal antecedent and is languishing in jail custody since 01-01-2016.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chapra Muffasil P.S.
