JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2020 Petitioner seeks bail in connection with POCSO Case No.50 of 2019, arising out of Mohania P.S. Case No.391 of 2019, G.R. No.1905 of 2019 registered for the offence punishable under Sections 363, 366(A) and 376 of the Indian Penal Code and Section 6 of POCSO Act.

Allegation against the petitioner is of kidnapping the minor daughter of the informant and same has been supported by the victim girl also in her statement recorded under Section 164 of the Cr.P.C. Apart from that the victim girl is minor, aged about 14 years, as per F.I.R., Submission of learned counsel for the petitioner is that there is no allegation against the petitioner except the allegation of kidnapping. He is in custody since 27.08.2019.

Patna High Court CR. MISC. No.4441 of 2020(2) dt.29-01-2020 2/2 Compromise has also been reached between the parties. Heard learned APP also.

In view of above facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. Accordingly, the application stands dismissed with condition that after framing of the charge, petitioner shall be at liberty to renew his prayer for bail.
