JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-06-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in connection with Sessions Trial No. 17 of 2016 arising out of Ariyari (Kasar O.P.) P.S. Case No. 111 of 2015 registered under sections 302 of the I.P.C. pending in the Court of District and Sessions Judge, Sheikhpura. The accusation is that son of the informant had gone with his friend Dharmendra Manjhi for taking his wife in Vidai at the house of the petitioner where the petitioner refused to send his daughter in Vidai, but his daughter came out from her house and boarded in the vehicle. Thereafter, hot talk started in between the petitioner and Dharmendra Manjhi and deceased Ranjit Manjhi. In

Patna High Court Cr.Misc. No.19252 of 2016 (3) dt.29-06-2016 2/2 that course, petitioner gave knife blow at his stomach and fled away from there. While Ranjit Manjhi was rushed for treatment but he died.

Learned counsel appearing on behalf of the petitioner submits that there is no repetition of the blow and the only one injury is caused due to spur of moment.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner for bail is rejected.
