The petitioner seeks bail in Bhabhua (Sonhan) P.S. Case No. 249/2015, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code. The petitioner and other accused persons are said to have surrounded the deceased and on such Ajay Singh stabbed the deceased Bigau Singh causing death of the deceased. There is no allegation of assault against the petitioner. Learned counsel for the informant, however, vehemently opposed the prayer and submitted that the petitioner had also surrounded the deceased and did not allow him to flee away. Patna High Court Cr.Misc. No.28005 of 2015 (2) dt.03-08-2015 2/2 been granted anticipatory bail vide order dated 22.07.2015 passed in Cr. Misc. No. 27862/2015. The petitioner is not the assailant of the deceased.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabhua, in connection with Bhabhua (Sonhan) P.S. Case No. 249/2015.
