JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-04-2019 This is an application for grant of anticipatory bail in connection with Kalyanpur P.S. Case No. 210 of 2018, disclosing offences under Sections 341, 324, 323, 326 and 307 read with 34 of the Indian Penal Code.

Allegation as per F.I.R. is that the petitioner had stabbed the informant twice.

Submission of learned counsel for the petitioner is that there is land dispute between the parties from before and due to that he has falsely been implicated in this case. Heard learned A.P.P. also, who opposed the prayer of anticipatory bail of the petitioner and submitted that opinion on injury has also been kept reserved.

Having heard both sides, in view of the facts and circumstances of the case as stated above, I am not inclined to

Patna High Court CR. MISC. No.7372 of 2019(4) dt.22-04-2019 2/2 grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.

Accordingly this application is dismissed.
