Petitioner seeks bail in a case registered under sections 379, 401, 411 of the Indian Penal Code. According to the F.I.R. informant was sleeping at railway plat form near enquiry office keeping green trolley bag behind his head, kept collected rupees of about 14 lacs and cheques of rupees 5 lacs with his cloths and when he awoke he found that his trolley bags was missing and suspected that some unknown persons have taken away his bag.

On behalf of the petitioner it is submitted that petitioner is in custody since 12.05.2015 and he has got no criminal antecedent. Petitioner is not named in the first

Patna High Court Cr.Misc. No.29407 of 2015 (2) dt.05-08-2015 2/2 information report and his name has come during the course of investigation.

On behalf of the State it is submitted that petitioner is not named in the first information report though theft property is said to have been recovered from his possession. Considering the aforesaid facts, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Railway Judicial Magistrate, Sonepur at Saran in Muzaffarpur Rail P.S.
