Mr.Nityanand ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 02-07-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Shahebganj P.S. Case No. 8/2012, instituted for offences under Section(s) 353, 307, 399, 402 and 302 of the Indian Penal Code read with Section 25(1b)a, 26, 27 and 35 of Arms Act. It is alleged in the written report that on getting secret information, police party reached at the place of occurrence. The accused persons started running away after making firing, seeing the police party. It is alleged that in the light of torch, Chaukidar Ramchandra Rai identified Shyamlal Sahni and this petitioner. It is further alleged that one of the miscreant, namely, Girija Sahni got injured due to aforesaid firing made by them.

Learned counsel for the petitioner has submitted that petitioner was not arrested on the spot.

The other co-accused Shyamlal Sahani has already been granted bail by a Co-ordinate Bench of this Court vide order dated 05.04.2013 passed in Cr. Misc. No. 40568/2012. Petitioner is in custody since 28.04.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., West Muzaffarpur, in connection with Shahebganj P.S. Case No. 8/2012, subject to the conditions that both the bailors shall be the close relative of the petitioner.
